Kenya : MP`s Imanyara, Muite to Sue Over Illegal Renditions

Imenti Central MP Gitobu Imanyara, former Kikuyu MP, Paul Muite, and human rights activists have teamed up to sue the Kenyan Government over illegal renditions.

Muite said Police Commissioner, Mathew Iteere, and head of the Anti-Terrorism Unit Nicholas Kamwende will face private prosecution for the "illegal renditions" and violation of the new Constitution.

"We also want to hear the voice of Parliament, which should make its position clear on the violation of the law," said Muite.

Muite told Government Spokesman Alfred Mutua he was exposing President Kibaki to impeachment proceedings for violating the law by defending the Government on the matter.

Muite was speaking on Friday at a human rights public forum on the 13 Kenyans who are among 38 people facing trials in Uganda over the Kampala bombing in July.

Eight Kenyans were illegally transported to Uganda while the co-ordinator of the Muslim Human Rights Forum Al-Amin Kimathi was arrested when he went to consult those facing trials.

He is also facing terrorism charges. Kenya National Commission on Human Rights commissioner Hassan Omar said the commission has talked with Muite and other lawyers to pursue criminal liability charges against Iteere, and Kamwende.

"KNCHR is going to investigate this matter and nobody will escape this. The jail holding Kimathi can also hold the police commissioner," Omar said.

Imanyara warned it was a criminal offence to transfer Kenyans to a foreign jurisdiction without due process.

"It is equally criminal for Ugandan authorities to hold a Kenyan citizen on tramped up charges," Imanyara said, in a statement Omar read on his behalf.

"We the people of Kenya reserve our sovereign right to take whatever action we deem necessary against Ugandan interests in Kenya, until Al-Amin Kimathi is released and repatriated," Imanyara said.

Former MP Billow Kerrow also supported legal action against Kenya and Uganda authorities.
